Introduction
This agreement encompasses all the complete terms and conditions that apply to your actions on our website, such as signing up, making purchases, participating in auctions, and any other activities. Once you use our website or make purchases through it, you are deemed to have agreed to be bound by its terms of use and are committed to complying with them. This agreement elaborates and constitutes the entire arrangement between QIYI-GIFTS.com (the seller) and you (the buyer), superseding all previous or concurrent agreements, statements, warranties, and understandings related to our website, products, the content and software provided via our website, as well as the subject matter of this agreement. We reserve the right to amend this agreement at any time without providing separate notice. The version of the agreement published on our website represents the most recent one, and you should carefully read these terms before using our website.
Website Usage and Prohibited Activities
Our website enables you to shop online. However, the following actions are strictly prohibited:
(a) If you are unable to enter into legally binding contracts, are under the age of 18, or have been temporarily or permanently suspended from using our website, services, or tools, you are not allowed to use our website, its services, and tools.
(b) You are prohibited from mining or collecting users’ personal information.
(c) Manipulating the price of any product or interfering with the normal operation of the website in any way is not allowed.
(d) You must not take any action that may damage the rating system.
To complete the registration process on our website, you are required to provide your full legal name, current address, a valid email address, and any other information necessary for registration. You must be at least 18 years old. Additionally, you are responsible for keeping your password secure and accountable for all activities and content uploaded under your account. Transmitting any worms, viruses, or destructive code is strictly forbidden.
Payment and Invoice Processing
QIYI-GIFTS.com exclusively sets the payment terms. Unless otherwise agreed, QIYI-GIFTS.com must receive the payment before accepting an order. In the absence of an agreed credit term, payment for products should be made via credit card, PayPal, or electronic check. Invoices are due and payable within the period specified on the invoice, starting from the invoice date. Unless otherwise stated, for all custom products, payment must be made before production can commence. Orders may be invoiced separately. QIYI-GIFTS.com has the right to decide at its discretion whether to cancel or reject an order. QIYI-GIFTS.com is not liable for any pricing, typographical, or other errors in its offers and reserves the right to cancel any orders resulting from such errors. For purchases other than those made by consumers, QIYI-GIFTS.com has the right to charge a late payment penalty of 1% per month on undisputed overdue amounts, or the maximum rate permitted by law, whichever is lower. An additional late payment penalty will be charged every 30 days thereafter.
Refund Policy
Within 30 days of purchase, for undamaged in-stock products, you can request a full refund for any reason. However, custom orders generally do not qualify for a refund.
Many of our products are custom-made, so each product may have slight variations and cannot be an exact match to the design. Minor differences (defined as aesthetic differences within 5% of the product) are considered normal and acceptable. If the received product is defective or you are dissatisfied with it, please inform us within 7 days of receipt, and we will be happy to assist you.
If you want to apply for any form of refund, the relevant products must be returned to our office. Please contact your sales representative or our customer service team to arrange for product pickup or obtain a return shipping label. We will cover the shipping costs for returning the products.
After receiving the returned products, we will inspect them for quality defects, manufacturing issues, and color or design deviations. We will only issue a refund if 6% or more of the products fail the inspection.Please keep in mind that these are handmade products.
If the products are found to be within the 5% tolerance range typical for handmade products, we will return them to you and charge you the shipping costs for the return. If the products are found to be defective during the inspection, we will remanufacture the products and send the new ones to you free of charge. Unless otherwise agreed in writing, the production time for remanufacturing usually ranges from 15 to 20 days.
Order Cancellation Policy
After placing an order, you can cancel a non-urgent order at any time before the production process starts. However, urgent orders cannot be cancelled once they are confirmed.
If the production has not yet begun, you will receive a full refund for the cancelled order. The start of production is marked by the mold manufacturer commencing the preparatory work for your customized product. Once this step is initiated, relevant fees will be incurred, and you will no longer be able to cancel the order to obtain a full refund.
If we have already started manufacturing the mold for your customized order and you decide to cancel it, you will be responsible for covering the mold costs and any other upfront preparation fees that we have already incurred. We will deduct these specified fees from the amount you have paid and refund the remaining balance to you.
Once we have completed the full production process of your customized products, you are required to pay the full amount, and no refund will be provided for the cancelled order.
Order Cancellation Fee
If an order paid for by credit card is cancelled, a 5% cancellation fee will be charged. This fee is used to cover the relevant costs and handling fees associated with the two credit card transactions. Thank you for your understanding. If the order is paid for by check or money order, there will be no cancellation fee.
Risk of Loss
All products purchased from our website are subject to a shipping contract. The risk of loss and the transfer of ownership of these products will be passed to you when we deliver them to the carrier.
Product Pricing and Descriptions
The listed price of products displayed on our website represents the full retail price indicated on the product itself, recommended by the manufacturer or supplier, or estimated in accordance with standard industry practices. It can also be the estimated retail value of a similar featured product offered elsewhere. The listed price is a comparative price estimate and may not represent the prevailing market price in every region on a specific date. For certain products sold as a set, the listed price may represent the “open-stock” price, which means the total sum of the manufacturer’s estimated or recommended retail price for each item included in the set. If a product is sold by one of our merchants, the listed price may be provided by that merchant. In the event of a pricing error in our product catalog where the correct price of the product is higher than the stated price, we reserve the right to either contact you for instructions before shipping or cancel your order and notify you of the cancellation.
We do not guarantee that the product descriptions or other content on our website are accurate, complete, reliable, up-to-date, or free of errors. If a non-customized product sold on our website does not match the description, your sole remedy is to return the unused product.
Rights Declaration
By using our website or making purchases through it, the buyer declares that they own, have obtained the authorization for, or have purchased the rights related to all registered trademarks, copyrighted images, logos, or content contained in their artwork that is reproduced by QIYI-GIFTS.com and EnamelPins, Inc. Given the above circumstances, the buyer hereby releases EnamelPins, Inc., its successors, legal representatives, licensees, and assignees from any claims or damages arising from or related to the use of this artwork, and shall indemnify them. You hereby acknowledge all rights, ownership, and interests of our website, including but not limited to those covered by intellectual property rights. Except as explicitly stated in this agreement, you will not acquire any rights, ownership, or interests in our website or related programs. You shall not modify, adapt, translate, create derivative works based on our services, software, or documentation, decompile, disassemble, or attempt in any other way to obtain the source code. You also shall not create or attempt to create alternative or similar services or products by using or accessing our related programs or proprietary information.
Editing, Deletion, and Modification
We reserve the right to edit, delete, or modify any of the terms and conditions in this agreement at any time at our sole discretion by posting a notice or a new agreement on our website. After we post a change notice or a new agreement on our website, your continued participation in our relevant activities, access to, and shopping on our website shall constitute a binding acceptance of the changes.
Fraudulent Activities
We closely monitor fraudulent activities on our website. If fraud is detected, QIYI-GIFTS will take all available remedies, and you will be responsible for all costs and legal fees resulting from such fraudulent activities.
Disclaimer of Warranty and Limitation of Liability
We shall not be liable for any indirect, special, or consequential damages, or any loss of revenue, profit, or data arising from this agreement or related activities, even if we have been informed of the possibility of such damages. Additionally, our total liability arising from this agreement and related activities shall not exceed USD2,000 or the total price of the relevant products you have paid or are due to pay, whichever is lower.
We do not make any express or implied warranties or representations regarding our related activities or any products sold and offered on our website (including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or any implied warranties arising from the course of dealing, trade usage, or performance). Furthermore, we do not guarantee that the operation of our website will be uninterrupted or error-free, and we shall not be liable for the consequences of any interruptions or errors. Our website and its information, content, materials, products, and services are provided on an “as is” and “as available” basis. You understand and agree that you use our website at your own risk.

QIYI-GIFTS always goes all out to ensure that we deliver products in a timely manner to meet your event requirements. However, QIYI-GIFTS will not be held responsible for delays caused by the following reasons:

You agree not to disclose any information that you obtain from us, our clients, advertisers, or suppliers. All information submitted by end-user customers in accordance with a program is the proprietary information of QIYI-GIFTS.com. Such customer information is confidential and should not be disclosed. The publisher agrees not to reproduce, disseminate, sell, distribute, or commercially exploit any of this proprietary information in any way.
Non-Waiver Statement
The failure of QIYI-GIFTS.com to demand strict compliance with any of the terms, conditions, and covenants of this agreement shall not be regarded as a relinquishment or waiver of any rights or remedies that we may possess. Nor shall it be interpreted as a waiver of any subsequent breaches of the terms, conditions, or covenants of this agreement. These terms, conditions, and covenants shall remain in full force and effect.
No waiver by either party of any breach of any provision of this agreement shall be considered a waiver of any subsequent or prior breaches of the same or any other provision.
Miscellaneous Provisions
This agreement shall be governed by and construed in accordance with the substantive laws of the United States of America, without reference to any conflict-of-laws principles.
Any disputes, controversies, or differences that may arise between the parties out of, in relation to, or in connection with this agreement are hereby irrevocably submitted to the exclusive jurisdiction of the courts of Illinois, excluding any other courts, and without giving effect to its conflict of laws provisions or your actual state or country of residence.
The entire agreement between the parties regarding the subject matter of this agreement is embodied herein, and no other related agreement shall bind either party.
Your rights, regardless of their nature, cannot be assigned or transferred to anyone, and any attempt to do so may result in the termination of this agreement, with no liability on our part. However, we may assign this agreement to any person at any time without prior notice.
If any provision of these terms and conditions is found to be invalid or unenforceable according to any judicial decree or decision, such provision shall be deemed to apply only to the maximum extent permitted by law, and the remaining terms and conditions shall remain valid and enforceable as per their terms.
